When it comes to preparing for and attending tribunal, it can often raise the stress levels of even the most seasoned Property Manager. Preparation is always key to your success at tribunal, and can help you to achieve the best possible outcome, barring the influences of the member on the day.
When you think about your tribunal preparation, how prepared are you? Are you ready to tackle those challenges?
A few key areas that you might like to look at;
Application and Responses
Gain the Landlord’s approval before making the application or attending as a respondent and find out what their ideal outcome may be. You may have a conversation at this point to pre-agree under what conditions you may withdraw application
Before applying, check that the Court has the jurisdiction for orders you are making and ensure you apply against correct individual/s or business. Specify which orders you request and give factual reasons for the request of those orders to be made.
Keep a copy of the documentation on file to refer to at a later stage
Check Termination Notices
Ensure that the termination notice was in writing and details the full address of the rented premises and the full names of all parties under the agreement. It also helps to ensure that you detail the grounds and details of the breaches. The notice also needs to be dated and signed.
Refer to the Management Agency Agreement and the Residential Tenancy Agreement where required and check dates for service of notices.
Preparation is Key
To assist with your case, gather evidence including correspondence, notices, agreements and ledgers. It also helps to prepare a chronology of events and write down all issues relating to the case
